Terms of Service

Welcome to Createhub. These Terms of Service ("Terms") govern your use of the Createhub mobile application, desktop application, websites at createhub.ai and automate.help, and all related services (collectively, the "Service"). The Service is operated by Automate Help LLC, a Texas limited liability company ("Createhub," "we," "our," or "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old, or the minimum age required in your jurisdiction (whichever is higher), to use the Service. If you are between the applicable minimum age and 18 (or the age of majority in your jurisdiction), you may use the Service only with the consent of a parent or legal guardian. By using the Service, you represent that you meet these age requirements.

2. Account Registration

To access certain features, you may need to create an account. You agree to:

• Provide accurate, complete information
• Keep your password secure and confidential
• Notify us promptly of any unauthorized access
• Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms.

3. License to Use the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or internal business purposes.

You may NOT:

• Reverse engineer, decompile, or attempt to extract the source code
• Resell, sublicense, or distribute the Service
• Use the Service to build a competing product
• Remove or modify proprietary notices
• Use the Service in violation of any law

4. Your Content

You retain full ownership of any code, projects, files, prompts, or other content you create or upload using the Service ("User Content").

You grant Createhub a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and process your User Content solely to operate and provide the Service to you.

We do not claim ownership of your User Content. We do not use your User Content to train AI models without your express consent.

5. AI-Generated Output

The Service uses artificial intelligence to generate code, text, and other outputs. You acknowledge that:

• AI output is provided "as is" and may contain errors, inaccuracies,

or unintended content

• You are solely responsible for reviewing, validating, and using AI

output appropriately

• We do not guarantee the correctness, completeness, or fitness for any

particular purpose of any AI output

• Some AI features rely on third-party providers (such as Anthropic and

OpenAI), and use of those features is also subject to their respective terms

• You are responsible for ensuring that AI-generated code or content

complies with any applicable open-source licenses, third-party rights, trademarks, and legal requirements before deploying, distributing, or otherwise using it

6. Subscriptions, Payments, and Refunds

Certain features may require a paid subscription. By subscribing, you authorize Automate Help LLC (or our payment processors, such as Stripe, Google Play, or Apple) to charge your payment method on the schedule disclosed at the point of purchase.

Subscriptions auto-renew unless cancelled. You may cancel at any time through your account settings or via the platform you subscribed through.

Refunds are handled according to the policy of the platform where you purchased the subscription (Google Play, Apple, or direct via Stripe). We are not obligated to provide refunds outside those policies, except where required by law.

7. Acceptable Use

You agree NOT to use the Service to:

• Violate any law or regulation
• Infringe on intellectual property or privacy rights of others
• Distribute malware, viruses, or harmful code
• Upload, transmit, store, generate, request, or distribute any content

that is illegal, including child sexual abuse material (CSAM) or content that exploits, endangers, or sexualizes minors

• Generate or distribute content that is defamatory, harassing, or

otherwise harmful

• Interfere with the operation of the Service or other users' enjoyment
• Attempt unauthorized access to our systems
• Scrape, mine, or harvest data from the Service

We may investigate suspected violations of these Terms, suspend or terminate accounts, preserve relevant records (including uploaded content, prompts, account information, IP addresses, and usage logs), and report apparent violations to appropriate authorities, organizations, or service providers as required by law or to protect the safety of others.

8. Intellectual Property

Createhub, the Createhub.ai trademark (USPTO Registration No. 8020362), the Createhub software, branding, and all related materials are owned by or licensed to Automate Help LLC. Except for the limited rights granted in these Terms, no rights are transferred to you.

9. Third-Party Services

The Service integrates with third-party services (including but not limited to Anthropic, OpenAI, Google Cloud, Google Play, Apple App Store, Stripe, and Firebase). Your use of those services is governed by their respective terms of service and privacy policies. We are not responsible for the practices or content of third parties.

10. DMCA / Copyright Infringement

If you believe content available through the Service infringes your copyright, contact us with:

• Identification of the copyrighted work
• Identification of the allegedly infringing material
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, secure, or free from harmful components, or that AI output will meet your requirements.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AUTOMATE HELP LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Automate Help LLC, its officers, members, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Service ends immediately.

You may stop using the Service and delete your account at any time.

15. Modifications to the Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a new "Last Updated" date. Material changes will be communicated through the Service or by email when possible. Continued use of the Service after changes constitutes acceptance.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. You agree that any disputes shall be resolved in the state or federal courts located in Williamson County, Texas.

17. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Automate Help LLC regarding the Service.
